Whether you like it or not, it's possible for someone other than you or your approved partners to sell your brand on Amazon. It doesn't matter if you are already selling it yourself. From selling under your Minimum Advertised Price (MAP) to submitting bad product data, unapproved sellers can wreak havoc that devalues your brand. And on top of that, Amazon doesn't consider unauthorized sellers their problem - the onus of brand representation is on you. So what can you do about it?
While you can't prevent someone who has your products from selling them on Amazon, there are ways to protect your brand against infringement by unauthorized resellers that incorrectly use your trademarked terms, logo, create product listings with your brand name, or sell your products from countries in which you don't manufacture or distribute your brand.
Brand Registry is crucial
The first step to protecting your brand on Amazon is to obtain Brand Registry. In order to qualify, your brand must have an active registered trademark in each country where you want to enroll. Amazon has restrictions on which countries they accept trademarks from, along with country-specific requirements. Once you've established Brand Registry, it will give you more control to make sure your brand is accurately represented on Amazon, you'll be able to find and report violations, and proactively prevent future violations. But how?
There are global, image and bulk ASIN search tools to look for potential infringements. In order to ensure MAP adherence, you'll need a weekly deep analysis of your brand that involves a detailed report of all pricing violations and unapproved sellers, supported by daily sweeps of all products identified with issues. Those infringements will then need to be reported to Amazon so they can review and take action.
